On Thanksgiving morning, Olivier Martinez dropped Gabriel Aubry with a few roundhouses to the face.
Now, according to TMZ sources, the Canadian model has dropped the restraining order he subsequently took out against the French actor.
With Halle Berry and Aubry having reached a legal settlement in their custody/protective order battle, Gabriel’s attorney went to court Friday and told a judge his client no longer needed to be kept away from Martinez.

Gabriel Aubry took another beating today, though, this time around, the Canadian model didn’t end up with any black eyes.
A family court judge shot down Aubry’s request to lift the restraining order put in place against him on Thanksgiving, which Halle Berry requested after Gabriel got into a brawl with Olivier Martinez.
As a result, he must remain at least 100 yards away from daughter Nahla.
Still, the protective order expires on Thursday. Berry and Martinez are expected in court again that day to ask for an extension.

The Canadian model was in court yesterday to hear a judge give him the good news, that he would not face any legal repercussions for allegations that he’s a danger when around three-year old daughter Nahla.
A dependency court case had been brought against Halley Berry’s ex after he allegedly shoved a nanny while she held his child and after an investigation revealed that Nahla is sometimes afraid of her father’s temper.

Sources tell TMZ the Canadian model will NOT be charged criminally for allegedly shoving his daughter’s nanny a few weeks ago, an act that has resulted in numerous hearings and court battles between Aubry and ex-girlfriend Halle Berry.
While a battery report was filed by the nanny in question, a Los Angeles County Attorney spokesman says there’s “insufficient evidence” against Gabriel to pursue any charges.

The Canadian model, who shares custody of three-year old Nahla with Halle Berry, is under investigation for allegedly screaming at his nanny last week and shoving her out a door… while the woman cradled the child in her arms.
