Perez Hilton and singer Miley Cyrus(HMG) – In a career repeatedly nourished by publicity stunts, even Perez Hilton may have now gone too far – The fame-loving blogger posted a tasteless photo of Miley Cyrus to his Twitter account Sunday that could finally see him facing charges.

The photo, which shows the still 17-year old Cyrus climbing out of a convertible in a short white dress sans underwear, which left her privates exposed, was posted to his Twitter account by Hilton at 11.08pm Sunday.

“If you are easily offended, do NOT click here <– link –> Oh, Miley! Warning: truly not for the easily offended!” it reads.

Well beside the usual lack of taste and discretion his is known for,  there’s another not so little snag – At 17, Miley is still legally a child, so by posting that picture the man is trading in child porn.

The offending shot has since been deleted, but despite claims [probably started by Perez] that it was ‘just photoshopped,’ the man faces trouble -  Dealing in child-porn carries a 15-year sentence and lifetime registration as a sex offender as its reward.

In fact, Hilton’s exposure in this case is “extraordinary and intense,” Los Angeles attorney, Jeffrey Douglas tells Salon, adding that it was “suicidal” for Hilton to do this.

“We’re not talking about a misdemeanor. You don’t have to know the law; all you have to do is knowingly distribute the photograph,” he says.

Douglas – a career lawyer who specializes in child porn cases – says it makes no difference whether Hilton took the shot, bought it or just ‘found’ it online – All he has to do to face 15-years in San Quentin is distribute that link — Even if the shot is a photoshopped fake.

“Under the law, that is still a crime,” assures Douglas. “And it is punishable just the same. If he’s not prosecuted for this, there is one reason why – His name is Perez Hilton.”

Neither Cyrus or Hilton have commented on the photo since it was posted. What do you think, should Perez be prosecuted for this photo?
